These Terms of Use (“Terms”) are a binding agreement between you and CensorPulse (“CensorPulse”, “we”, “us”, or “our”) governing your use of the CensorPulse mobile application and related services (together, the “Service”). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you obtained the Service through the Apple App Store or Google Play, the Apple‑specific and Google‑specific terms in Section 12 also apply.
CensorPulse is a network‑diagnostics tool. It measures whether the network you are on interferes with connections to a built‑in list of public websites and services, across several layers of the connection (DNS, TCP, TLS, and TLS server‑name / SNI) plus an app‑layer HTTP reachability check, and reports what it observes.
CensorPulse is not a VPN, proxy, or circumvention tool. It does not route, tunnel, or modify your internet traffic, does not make you anonymous, and does not provide access to, or bypass any restriction on, any content or service. It only measures and reports.
You must be at least the age of majority in your jurisdiction, or the minimum age required to form a binding contract and to consent to data processing under your local law, to use the Service. By using the Service you represent that you meet these requirements.
You agree to use the Service only for lawful purposes and in compliance with all applicable laws and with these Terms. You are solely responsible for ensuring that running network measurements is lawful for you on the networks you use and in your jurisdiction, and for complying with the acceptable‑use rules of any network you test. The Service is currently provided free of charge and contains no in‑app purchases or subscriptions in this version. If we introduce paid features in the future, we will present the applicable terms and pricing before you buy, and purchases will be handled by the Apple App Store or Google Play under their terms.
The Service depends on third parties (for example, app stores, public DNS resolvers, IP‑lookup providers, and the destinations it probes) and on the availability of the internet. We are not responsible for third‑party services or for interruptions outside our control.
Your use of the Service is also governed by our Privacy Policy, available at https://xarvel.github.io/apps/censorpulse/privacy-policy, which explains what data the App processes and why. By using the Service you acknowledge the Privacy Policy.
The Service, including its software, design, and trademarks, is owned by CensorPulse or its licensors and is protected by law. Subject to these Terms, we grant you a limited, personal, non‑exclusive, non‑transferable, revocable license to use the Service on devices you own or control, for your personal, non‑commercial use. The Service may include open‑source components licensed under their own terms.
We aim to keep the Service reliable but do not guarantee that it will be uninterrupted, error‑free, or available in every location. We may modify, suspend, or discontinue any part of the Service at any time. Measurement behavior depends on the network you are on and on the availability of the destinations being probed.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
CensorPulse produces best‑effort diagnostic indicators, not definitive proof. Network conditions, caching, load balancing, geo‑distribution, and middleboxes can cause false positives or false negatives, and results can change from moment to moment and from network to network. You should not treat the App’s output as legal, security, or professional advice, or as a guarantee about the state of any network or service. The App does not route or modify your traffic and provides no anonymity or circumvention.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CENSORPULSE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE (WHICH, FOR THE FREE SERVICE, IS ZERO) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
You may stop using the Service and uninstall the App at any time. We may suspend or terminate your access if you violate these Terms or if required to protect the Service or comply with law. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
Apple App Store. These Terms are between you and CensorPulse only, not Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. In case of a failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the Service, including product‑liability, legal/regulatory, or consumer‑protection claims. Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist‑supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
Google Play. Your use of the Service is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the Service.
These Terms are governed by the laws of the jurisdiction in which CensorPulse is established, without regard to conflict‑of‑laws rules, except where mandatory consumer protection laws of your country of residence apply. Nothing in these Terms limits any non‑waivable statutory rights you may have as a consumer.
We may update these Terms from time to time. We will post the updated version at this URL and update the “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
